Preamble / The Code of Directness

Untone is a tool for logical, structural, and hyper-personalized B2B outreach. We build software to agitate ideas, facilitate philosophical debates, and drive real commercial reaction. We do not tolerate mass consumer spam, deceptive phishing schemes, or digital noise. By utilizing our infrastructure, you agree to speak directly, clearly, and take absolute responsibility for your outreach.

1. Acceptance of Terms

By registering for, accessing, or using the services provided by Untone (collectively, the "Service" or "Platform"), you enter into a legally binding contract with Untone Sys Ltd. ("Untone", "we", "us", or "our"). If you do not agree to these Terms of Service ("Terms"), you are strictly prohibited from utilizing our tools, APIs, and infrastructure.

These Terms apply to all visitors, users, operators, and organizations who register an account or access the Platform. Your access is contingent upon your compliance with and acceptance of these Terms without modification.

2. Acceptable Use Policy (AUP)

Untone is engineered exclusively for legitimate Business-to-Business (B2B) communications. You represent and warrant that your use of the Platform conforms to all applicable local, national, and international laws, including but not limited to CAN-SPAM, GDPR, CCPA, and CASL.

Strict Prohibitions:

  • No B2C Spam: You shall not use Untone to send unsolicited messages, marketing copy, or communications to individual consumers, private citizens, or list-purchased personal addresses.
  • No Phishing or Deception: You shall not transmit messages designed to extract credentials, masquerade as financial institutions, or execute social engineering attacks.
  • No Illegal Scraping: You shall not target websites, endpoints, or data networks in violation of their robots.txt files, terms of use, or local computer abuse statutes.
  • No Content Agitation of Protected Classes: While we encourage logical debate and direct messaging, you may not use our AI models to generate hate speech, harassment, threats, or slander.

3. Security, Auditing & Admin Access

As between you and Untone, you retain ownership of all target lead lists, data inputs, and historical outreach outputs that you import into your workspace. However, to maintain platform stability, verify compliance with our Acceptable Use Policy, prevent malicious usage, and ensure quality control, you hereby grant Untone Administrators explicit permission to access and audit your workspace.

This includes, but is not limited to, the secure review of your imported contact lists, target company profiles, generated message hooks, custom LLM instructions, and outreach logs. Untone staff will only execute these security audits under secure, logged administrative access, and all retrieved information is bound by our strict confidentiality guidelines.

4. Account Suspension & Termination

Untone operates on a zero-tolerance policy for platform abuse. We reserve the absolute right, in our sole discretion and without prior notice, liability, or obligation to refund subscription fees, to suspend or terminate your account immediately if:

  • You violate any provision of these Terms or our Acceptable Use Policy.
  • Your outreach campaigns trigger excessive bounce rates, spam complaints, or domain blocks on our sending nodes.
  • You attempt to reverse engineer, bypass, or overload our AI models, scrapers, or hosting network.
  • Required payments are not completed on time.

5. Limitation of Liability

To the maximum extent permitted by law, Untone and its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to, use of, or inability to access or use the Service.
  • Any content obtained from the Service, including AI-generated message hooks and scraping responses.
  • Unauthorized access, use, or alteration of your transmissions or data.
  • Delivery failures, email blocks, or IP blacklisting resulting from outreach campaigns run through the Platform.

Untone provides the Platform on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied.

6. Governing Law

These Terms shall be governed, construed, and enforced in accordance with the laws of the jurisdiction in which Untone operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
